Affirmative Asylum

Affirmative asylum is a form of asylum sought by individuals who are already in the destination country (e.g., United States) and have not been placed in removal proceedings. The applicant initiates this process by submitting an asylum application to destination country's agency (e.g., U.S. Citizenship and Immigration Services (USCIS)) rather than presenting their case before an immigration judge.
